Terms and Conditions

Welcome to Sugar Bloom

The Sugar Bloom website is operated by FabFinds Limited, trading as Sugar Bloom ("Sugar Bloom", "we", "our" or "us").

FabFinds Limited is a company registered in England and Wales under company number 10809071, with its registered office at 1 Hallaton Street, Leicester, LE2 8QY.

These Terms and Conditions apply to your use of the Sugar Bloom website and to purchases made through it.

We may update these Terms and Conditions from time to time. The Terms and Conditions which apply to an order will be those in force at the time the order is placed.

General Information

We take reasonable care to ensure that the information, product descriptions, images, measurements, prices, and other content displayed on our website are accurate.

Product images are provided in good faith and are intended to give a fair representation of the products offered for sale. However, the appearance and colour of products may vary slightly due to photography, lighting, manufacturing variations, and the screen or device used to view the website.

All dimensions, weights, capacities, and measurements are approximate unless expressly stated otherwise.

Nothing in these Terms and Conditions affects your statutory rights where goods are materially different from their description.

Products

Products offered for sale through Sugar Bloom are intended primarily for normal domestic and personal use unless otherwise stated.

All products are subject to availability.

Adding an item to your basket does not reserve that product and availability may change before an order is completed.

We reserve the right to change, discontinue, or update products and product ranges at any time.

Where a product is supplied with ingredients, warnings, care instructions, safety information, usage instructions, or manufacturer guidance, you should read and follow this information before using the product.

Prices

All prices displayed on the Sugar Bloom website are shown in pounds sterling (GBP) and include VAT where applicable.

Any applicable delivery charges will be shown separately before you complete your purchase.

The total amount payable for your order will be shown before you place the order.

We take reasonable care to ensure that prices displayed on our website are correct. However, errors may occasionally occur.

If we discover an obvious pricing error relating to an order before it has been dispatched, we may contact you to advise you of the correct price and give you the option to continue with the purchase at the correct price or cancel the affected item or order.

If we are unable to contact you, we may cancel the affected item or order and refund any amount already paid.

We will not charge you a higher price without your agreement.

Orders

When you place an order through the Sugar Bloom website, you are offering to purchase the products contained within that order.

You will receive confirmation that we have received your order. All orders remain subject to availability and acceptance.

If we are unable to supply an item you have ordered, we will notify you and refund any amount you have paid for that item.

If only part of an order becomes unavailable, the remaining available products may still be supplied and the unavailable products refunded.

Please check the information provided during checkout carefully before placing your order.

Once an order has been submitted, we cannot guarantee that we will be able to amend or cancel it before dispatch. If you need to make a change, please contact us as soon as possible at marketing@sugarbloom.co.uk.

This does not affect your statutory cancellation rights.

Payment

We accept the payment methods displayed and made available to you at checkout.

Payment is subject to authorisation by your chosen payment provider.

We will not be responsible for delays caused by your bank or payment provider declining, delaying, or otherwise failing to authorise a payment.

We do not store complete customer payment card details where those details are processed directly by authorised third-party payment providers.

Your bank, card issuer, or payment provider may impose its own charges or fees. We are not responsible for charges imposed independently by your chosen payment provider.

Delivery

Available delivery services, estimated delivery times, and applicable charges will be displayed during checkout.

We will take reasonable steps to deliver orders within the estimated timeframe provided.

Where a delivery is delayed due to circumstances outside our reasonable control, we will take reasonable steps to minimise the effect of the delay and keep you informed where appropriate.

Please ensure that the delivery address and other information supplied when placing an order are complete and accurate.

Risk in the goods generally passes to you when the goods come into your physical possession, or the physical possession of another person you have identified to receive them on your behalf, subject to your statutory rights.

Promotions

Sugar Bloom reserves the right to amend, suspend, or withdraw any promotion at any time, subject to applicable law and any rights which have already arisen under a completed purchase.

Website Security

The Sugar Bloom website uses appropriate security measures, including SSL encryption, to help protect information transmitted through the website.

Payment information may be processed by authorised third-party payment providers in accordance with their own security and privacy practices.

Please see our Privacy Policy for further information about how personal information is collected, used, stored, and protected.

Your Statutory Rights

Nothing in these Terms and Conditions excludes, restricts, or otherwise affects your statutory rights as a consumer.

Under the Consumer Rights Act 2015, goods supplied to consumers must meet certain legal requirements, including being:

  • Of satisfactory quality

  • Fit for purpose

  • As described

Additional statutory rights may apply depending on the circumstances.

Faulty, Damaged, or Incorrect Products

If you receive a product which is faulty, damaged, incorrect, or not as described, please contact us at marketing@sugarbloom.co.uk as soon as reasonably possible.

To help us investigate the issue, we may ask you to provide your order number, details of the affected product, photographs showing the issue, and photographs of the packaging where relevant.

Providing this information helps us resolve problems more quickly, but your statutory rights are not dependent upon reporting a fault or damage within 48 hours.

Faulty Goods Within 30 Days

Where goods do not meet the requirements of the Consumer Rights Act 2015, you may have a short-term right to reject them within 30 days and receive a refund.

The 30-day period may be shorter for goods which can reasonably be expected to perish within a shorter period.

You may choose to request a repair or replacement instead where appropriate.

Faulty Goods After 30 Days

Where a fault is identified after the initial 30-day period, you may be entitled to a repair or replacement.

Any repair or replacement must be completed within a reasonable time and without causing significant inconvenience.

Depending on the circumstances, where a repair or replacement is unsuccessful, unavailable, disproportionate, or cannot be provided within a reasonable time and without significant inconvenience, you may be entitled to a price reduction or to exercise a final right to reject the goods.

Where goods are rejected because they are faulty or otherwise fail to conform to the contract, we will bear reasonable return costs where required by law.

Any manufacturer's warranty or guarantee supplied with a product is in addition to, and does not replace or reduce, your statutory rights.

Products Damaged in Delivery

If your order arrives damaged, please contact us at marketing@sugarbloom.co.uk as soon as reasonably possible so that we can investigate the issue.

Where possible, please provide:

  • Your order number

  • Details of the affected product

  • Photographs clearly showing the damage

  • Photographs of the packaging where relevant

Reporting delivery damage promptly can help us investigate the matter with the delivery provider.

Your statutory rights are not affected if you do not report delivery damage within 48 hours.

Depending on the circumstances and your statutory rights, an appropriate remedy may include a refund, replacement, or repair.

We may reasonably require an affected item to be returned or made available for collection before a replacement or refund is issued.

Where goods are faulty, damaged, incorrect, or otherwise do not conform to the contract, we will bear reasonable return costs where required by law.

Cancellation and Unwanted Goods

When you purchase goods online, you will generally have a legal right to change your mind and cancel the contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

For most goods, you have 14 days from the day after the goods come into your physical possession to tell us that you wish to cancel.

Where multiple goods have been ordered as part of the same order and are delivered on different days, the cancellation period generally runs from the day after the final item is received.

You do not need to provide a reason for cancelling.

To exercise your right to cancel, contact us at marketing@sugarbloom.co.uk and clearly tell us that you wish to cancel your purchase.

Once you have told us that you wish to cancel, goods must normally be returned within a further 14 days.

We will provide you with the appropriate return instructions.

Exceptions to the Right to Cancel

The statutory right to cancel does not apply to certain types of goods and contracts.

Depending on the products sold, this may include:

  • Goods made to your specifications or clearly personalised

  • Goods which are liable to deteriorate or expire rapidly

  • Sealed goods which are not suitable for return for health protection or hygiene reasons where the seal has been broken after delivery

  • Other goods or services which are excluded from the statutory cancellation right under applicable law

These exceptions do not affect your rights where goods are faulty, damaged, incorrect, or not as described.

Condition of Unwanted Returns

You may examine and handle goods in the same way that you would reasonably be able to examine them in a shop.

You are responsible for taking reasonable care of goods while they are in your possession.

Where goods have been handled beyond what is reasonably necessary to establish their nature, characteristics, and functioning, and their value has been reduced as a result, we may make an appropriate deduction from the refund where permitted by law.

Where reasonably possible, products should be returned with any packaging, accessories, components, instructions, and other items originally supplied with them.

A lack of original packaging does not automatically remove your statutory right to cancel.

Refunds for Cancelled Orders

Where you validly exercise your statutory right to cancel, we will refund the amount required by law.

This will generally include the price paid for the goods and the cost of our least expensive standard delivery option offered when the order was placed.

If you selected a more expensive delivery service, such as express delivery, we are not required to refund the additional cost above our standard delivery charge.

Where goods are being returned following cancellation, we may withhold the refund until we have received the goods back or you provide evidence that they have been returned, whichever occurs first.

Refunds will normally be made using the same payment method used for the original transaction unless otherwise agreed.

We will not charge a fee for issuing a statutory refund.

Returns

Before returning goods, please contact us at marketing@sugarbloom.co.uk so that we can provide the appropriate return instructions.

For unwanted goods returned under your statutory right to cancel, responsibility for return costs will be determined in accordance with the information provided in our Returns Policy and applicable consumer law.

Where goods are faulty, damaged, incorrect, or not as described, we will cover reasonable return costs where required by law.

Manufacturer Warranties

Some products may be supplied with a manufacturer's warranty or guarantee.

Any manufacturer's warranty is provided in addition to your statutory rights and does not replace or restrict those rights.

Where a product is covered by a manufacturer's warranty, please contact us if you require assistance regarding a fault.

Events Outside Our Control

We will not be responsible for a failure or delay in performing our obligations where that failure or delay is caused by an event outside our reasonable control.

This may include, for example, severe weather, natural disasters, industrial action, transport disruption, failure of telecommunications or utility networks, acts of terrorism, civil disturbance, or other circumstances which we could not reasonably prevent.

Where such an event affects an order, we will take reasonable steps to minimise the impact and will contact you where appropriate.

Nothing in this section affects any statutory rights you may have where goods are not delivered within a legally required period.

Limitation of Liability

Nothing in these Terms and Conditions excludes or limits liability where it would be unlawful for us to do so.

In particular, nothing in these Terms and Conditions excludes or limits our liability for:

  • Death or personal injury caused by our negligence

  • Fraud or fraudulent misrepresentation

  • Breach of your statutory rights in relation to the goods

  • Any other liability which cannot lawfully be excluded or limited

Our products are intended primarily for domestic and personal use unless expressly stated otherwise.

Where permitted by law, we are not responsible for business losses, including loss of profits, loss of business, loss of business opportunity, or business interruption, arising from the use of products purchased primarily for domestic purposes.

We will not be responsible for losses which were not reasonably foreseeable when the contract was entered into or which were not caused by a breach of our obligations.

Intellectual Property

Unless otherwise stated, the content of the Sugar Bloom website, including branding, logos, text, graphics, images, product photography, website design, and other materials, belongs to or is licensed to FabFinds Limited.

You may not reproduce, distribute, modify, publish, commercially exploit, or otherwise use website content without our prior permission, except where permitted by law.

Privacy

We process personal information in accordance with our Privacy Policy and applicable data protection legislation.

Please read our Privacy Policy for information about how we collect, use, retain, and protect personal information.

Governing Law

These Terms and Conditions and any contract between you and us are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you may also benefit from mandatory rights and protections available under the laws applicable where you live.

Nothing in these Terms and Conditions affects any mandatory rights you have regarding where legal proceedings may be brought.
